Triple talaq an important issue, cannot be scuttled, says CJI JS Khehar; SC seeks written submissions from all parties

The triple talaq issue was heard today in Supreme Court and Chief Justice JS Khehar stated that it is an important issue cannot be scuttled. Further, TV reports cited the possibility of a Constitution Bench to hear the triple talaq issue. On Twitter, ANI had reported, “Supreme Court asks all respective parties to give their written submissions to the Attorney General by March 30.” Triple talaq is a controversial political issue in India as it lets a Muslim man divorce his wife by uttering the words ”Talaq” thrice, as per Muslim personal laws. One of the petitioners, 38-year-old Shayara has challenged the triple talaq, the practice of polygamy as well as the practice of nikah halal which requires the divorced woman to consummate another marriage to return to her husband. Despite the fact that many women petitioners approached Supreme Court seeking the legal quashing of this practice, there is much opposition to their demand.

Wondering what the government’s official stand is? Well, the stand taken by the Central government is that gender injustice should end and there should be equality between men and women in accordance with the provisions of the Constitution.

Earlier, the Bharatiya Muslim Mahila Andolan had also pitched for abolishing the triple talaq practice instead of merely debating on it. They state clearly their stand is that the triple talaq debate is being wrongly confused with the Uniform Code issue and that the two are separate issues altogether.

The Supreme Court has now directed all parties to file their submissions and detailed hearing on the same is expected from May 11 onwards.
